Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Kachiball mobile application, websites, and related services (the "Service"), operated by Kachiball ("Kachiball", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be 18 years of age or older to use the Service. By using Kachiball, you represent that you meet this requirement and that the information you provide is accurate.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. The Service

Kachiball is a marketplace that connects players ("Players") with sports venues ("Venues"). Venues list fields and availability; Players discover and book time slots. Kachiball facilitates these bookings and processes payments, but the sporting activity and the physical premises are provided by the Venue.

4. Bookings and payments

Prices, durations, and any applicable fees are shown before you confirm a booking.
Payment is collected at the time of booking through our payment processor, Stripe. Kachiball acts as merchant of record and remits funds to Venues, less applicable platform and processing fees.
You authorize us to charge your selected payment method for the total shown at checkout.
A confirmed booking is a reservation of the selected field and time, subject to the Venue's rules and policies.

5. Cancellations and refunds

Each Venue sets its own cancellation policy, which is shown on the venue's details. You may manage and cancel eligible upcoming bookings in the app. Refunds, when applicable, are reviewed and issued through the app and processed via Stripe. Refund timing depends on your bank or card issuer.

6. Reviews and content

You may submit reviews and ratings for venues you have booked. Content must be accurate, lawful, and respectful. You grant Kachiball a non-exclusive, worldwide license to display and distribute your reviews within the Service. We may remove content that violates these Terms.

7. Assumption of risk and waiver

Sports and recreational activities involve inherent risks, including risk of injury. You participate voluntarily and at your own risk. To the fullest extent permitted by law, you assume all such risks and release Kachiball from claims arising out of your participation. Venues may require you to accept additional waivers; your acceptance is recorded as described in our Privacy Policy.

8. Prohibited conduct

Using the Service for unlawful purposes or to harass, harm, or defraud others.
Circumventing payments, fees, or booking controls.
Posting false, misleading, or infringing content.
Attempting to disrupt, reverse engineer, or gain unauthorized access to the Service.

9. Venue operators

If you register as a Venue, you are responsible for the accuracy of your listings, availability, pricing, and compliance with applicable laws, taxes, and licensing. You must honor confirmed bookings and your stated policies, and complete any required onboarding (including identity and payout verification through Stripe).

10. Intellectual property

The Service, including its software, design, and trademarks, is owned by Kachiball and protected by law. These Terms do not grant you any rights to our trademarks or branding without prior written consent.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that venues will meet your expectations.

12. Limitation of liability

To the fullest extent permitted by law, Kachiball will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid through the Service in the three months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Kachiball and its affiliates from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

14. Governing law

These Terms are governed by the laws of the United States and the state in which Kachiball is established, without regard to conflict-of-laws principles.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
